THE UTTAR PRADESH LEVY OF FEES FOR TESTING AND INSPECTION

ORDER, 2009

(See rules 7 and 46 of the Indian Electricity Rules, 1956)

1. (1) This order may be called the Uttar Pradesh Levy of fees for testing and Inspection order, 2009.

(2) It shall come into force with effect from the date of notification.

2. In the order the learns and expressions used shall have the same meaning as they have in the section 185 (1) of Electricity Act, 2003 and the Indian Electricity Rules 1956 except that for the purpose of the order.

(a) “Owner” shall include an occupier of any building, place, carriage or vessel in which energy is, or is about to be generated, received or used.

(b) “Initial” with reference to the inspection, examination or test of any Electrical Installation or apparatus shall mean be first inspection carried out by the Electrical safety Directorate, either before or after is being brought into use, or its connection after having being without supply for a period of six months or more and shall include the first inspection, examination or test necessitated as a result of an extension or alternation in the exciting installation.

Except those inspection, examination or test of any electrical installation carried out under the instruction of the electrical Safety Directorate with the sole purpose of rectifying defective installation already inspected by the said Directorate.

(c) “Periodical” with reference to the Inspection, examination or test of any electrical installation or apparatus shall mean the inspection or test carried out in pursuance of rule 46 of the Indian Electricity Rules, 1956.

(d) “Subsequent” with reference to the Inspection examination or test of any electrical installation or apparatus shall mean the inspection or test necessitated due to the Installation or apparatus having been found to contravene the relevant requirement of the Indian Electricity Rules, 1956 during an initial or any other inspection, and

(e) “Licensee” shall include the Uttar Pradesh Power Corporation Ltd/ Electricity Distribution Corporation Ltd. And also a person engaged in the business of supplying energy with the sanction of the Government obtained under section 14 of the Electricity Act, 2003.

3. Subject to the following condition fees shall be levied for testing and inspection (including periodical inspections) and generally for the services of Electrical Safety Directorate under the electricity Act, 2003 and the Indian Electricity Rules 1956 as amended from time to time and shall be realized from the persons and in accordance with the scales specified in the schedule:-

(1) In the case of any inspection, examination or test specified in scales ”A” to “D” no fees shall be levied for a second or subsequent inspection. Examination or test made within a period of twelve month from the date of a similar inspection, examination or test for which prescribed fee has been paid unless such further inspection, examination or test for which prescribed fee has been paid unless such further inspection, examination or test is made on application or in pursuance of the periodicity prescribed by the State Government under rule 46 of the Indian Electricity Rules 1956 or is necessary as the result of an extension or the attention of the installation or is in the opinion , which will be recorded, of the Electrical Safety Directorate necessitated by a breach of any of the provisions of the Act or of the rules made there under or by the neglect or failure of the licensee or owner to carryout, within the stipulated time, any written order of electrical Safety Directorate.

(2) The fee for subsequent inspection or test of an installation if necessitated as a result of detection of defects during initial or any other inspection will be as prescribed under scales “A” to “E”

(3) In the case of an inspection, examination or test specified in scales “f” to “K” no fee shall be levied for an inspection, or examination or test unless :-

(i) Such inspection, examination or test is made or application or for conducting periodical inspection under rule 46 of the Indian Electricity Rules 1956, or

(ii) It is established to the satisfaction of the Electrical Safety Directorate, who will make record of the grounds on which he is satisfied, that the installation or apparatus inspected, examined or tested is not in accordance with the provisions of the Act or any rule made thereunder and in the case the fee for initial as well as subsequent inspection shall be chargeable and

(iii) The fee for subsequent inspection and test if necessitated as be full fee as prescribed in scale “D” to “M”

4 (i) The fees payable under this order shall be paid into payment of fees Government treasury in advance under the following 1 leads of Account:-

(a) For scales otherthan scale “M” and “O” under the Head-“0043-Duties and fees on electricity. 102-fee for inspection under Indian Electricity Rules.”

(b) For scales “O” under the 1 lead “0043- Duties and fees on Electricity 103-free for inspection of Electrical Installation of Cinema.”

(c) For scales “M” under the Head-“0043-Duties and fees on Electricity, 100- Other Recepts.”

(ii) The fees shall pad by the owner of the installation excluding non Commercial Department of the State Government except where provided otherwise.

(iii) If at the request of a consumer or supplier, journeys are under taken to inspect, exanine or test an electrical installation or an apparatus and if on arrival of the inspecting officer, installation or apparatus is not found, the prescribed fee shall be charged.

Exceeding 100 KWs but not exceeding 500 KWs. Rs.675-500 plus Rs.135/- for every 50 KWs. Or part there of in excess of 100 KWs. Rs.2000-00 Plus Rs.400/-for every 20 KWs. Or part thereof in excess of 100 KWs.
Exceeding 500 KWs but not exceeding 1000 KWs. Rs-3375-00 plus Rs.270/- for every 50 KWs or part thereof in excess of 500 KWs. Rs-10000-00 plus Rs.1000/- forevery 50 KWs. Or part thereof in excess of 500 KWs.
Exceeding 1000 KWs Rs.6750/- Rs. 22500/-

For an inspection, examination or test of each generating station or other places in which energy is , or is about to be generated at a pressure of 100 Volts or more:-
